Privacy Policy

This policy explains what personal data VividSoft Tech Solutions ("VividSoft", "we", "us") collects through vividsoft.in and when you contact us, why we collect it, and the choices you have. We wrote it to comply with India's Digital Personal Data Protection Act, 2023 and the Information Technology Act, 2000, and to be clear for clients outside India.

1. Who is responsible

VividSoft Tech Solutions, 17/445, Chopasni Housing Board, Jodhpur, Rajasthan 342008, India, decides how personal data described in this policy is used (the "data fiduciary" under Indian law, or "controller" under GDPR).

2. What we collect

• Information you send us. When you email us, we receive your name, email address, and whatever you include, such as your company, role, phone number and project details.
• Technical logs. Our hosting provider records standard request data (IP address, browser type, page requested, date and time) to deliver the site and protect it from abuse.
• Font requests. The site loads typefaces from Google Fonts, so your browser sends your IP address to Google when the page loads.

We do not use cookies, analytics, advertising pixels or any other tracking on this website, and we do not knowingly collect sensitive personal data through it.

3. Why we use it

• To reply to your enquiry and discuss, scope and quote for work.
• To enter into and perform a contract with you or your organisation, including invoicing.
• To keep the website secure and working.
• To meet legal, tax and accounting obligations.

We rely on your consent when you choose to contact us, on the steps needed to enter into or perform a contract, and on legal obligations. We do not sell your personal data or use it for automated decision-making.

4. Who we share it with

Only with service providers that help us run the business, under their own confidentiality and security terms:

• Microsoft 365, for email.
• Vercel Inc., for website hosting.
• Google, for web fonts.
• Professional advisers such as accountants and lawyers, where needed.

We may also disclose data where Indian law, a court or a government authority requires it. Some of these providers process data outside India, including in the United States and the European Union, with safeguards appropriate to that transfer.

5. Data in client projects

When we build or run software for a client, any personal data inside that system belongs to the client. We process it only on the client's instructions under our contract and any data processing agreement, and the client's own privacy policy applies to it. This policy does not cover that data.

6. How long we keep it

Enquiries that do not lead to work are deleted within 24 months of our last exchange. Contract, invoice and related records are kept for as long as Indian tax and accounting law requires. Hosting logs are kept by our provider for a short period, generally no more than 30 days.

7. Security

The site is served only over HTTPS. Our email and business systems use access controls and multi-factor authentication. No method of transmission or storage is perfectly secure, but we take reasonable measures to protect your data and will notify you and the relevant authority of a breach where the law requires it.

8. Your rights

You can ask us to:

• tell you what personal data we hold about you and how we use it;
• correct, complete or update it;
• erase it, where we are not required to keep it;
• withdraw consent you have given, without affecting earlier processing;
• nominate another person to exercise these rights on your behalf in case of death or incapacity.

Email hr@vividsoft.in to make a request. We reply within 30 days. If you are not satisfied with our response, you may complain to the Data Protection Board of India or, if you are in the EU or UK, to your local data protection authority.

9. Children

This website and our services are meant for businesses. We do not knowingly collect personal data from anyone under 18.
